1. General Provisions
This Open License sets out the terms and conditions for the free use of audio recordings made available in the music catalog of the website neonafm.ru (hereinafter referred to as the “Website”).
Licensor: Natalia Viktorovna Orlovskaya / self-employed individual.
This License applies to all audio recordings available for download on the Website unless separate terms of use are expressly specified for a particular recording.
For the purposes of this License, “audio recordings” means phonograms and, to the extent that the relevant subject matter is protected by copyright law, the musical works embodied therein.
The Licensor grants any individual, individual entrepreneur, or legal entity a royalty-free, non-exclusive license under the terms and conditions set forth below.
2. Acceptance of the License
Downloading an audio recording from the Website or commencing its use constitutes full acceptance of the terms and conditions of this Open License.
No separate written permission, individual agreement, or license fee is required.
3. Permitted Use
The User may use the audio recordings free of charge for both non-commercial and commercial purposes.
In particular, the User is permitted to:
- download and store audio recordings on computers, mobile phones, storage devices, media players, and other devices;
- make copies of audio recordings in the quantity reasonably necessary for the permitted use;
- combine audio recordings into the User’s own playlists;
- adjust volume, apply fade-ins and fade-outs, convert files into other audio formats, and make other technical modifications necessary for playback;
- publicly play audio recordings as background music on premises and in areas used by individuals, individual entrepreneurs, and organizations;
- use audio recordings in beauty salons, hair salons, shops, offices, studios, hotels, cafés, restaurants, medical and cosmetology facilities, fitness clubs, sports centers, waiting areas, exhibition spaces, and other public and commercial premises.
Such use is permitted regardless of whether the User derives income from their primary business or other activities.
No remuneration shall be payable to the Licensor for any use permitted under this License.
4. Attribution
The User is not required to identify the Licensor, provide the Website address, or indicate the source from which an audio recording was obtained when playing or otherwise using the recording.
The User may, at their discretion, identify the Website as the source of the music.
5. Restrictions
This License does not grant the User the right to represent audio recordings as musical works or phonograms created by the User.
The audio recordings themselves may not be sold or made available for a fee as standalone music products.
The User may not create their own music libraries, catalogs, music banks, or similar services from the audio recordings for subsequent distribution to third parties.
The User may not register the audio recordings in their own name with automated rights-management systems, Content ID, or similar systems, nor assert monetary or proprietary claims against third parties for their use of the audio recordings licensed under this License.
The restrictions in this Section do not prevent ordinary use of the audio recordings as background music in commercial activities.
6. Term and Territory
This License applies worldwide.
The right to use the audio recordings is granted for the entire period during which the relevant exclusive rights or related rights are held by the Licensor.
Removal of a particular audio recording from the Website does not, by itself, terminate the rights of Users who lawfully obtained that audio recording while this License was in effect.
7. Rights to Audio Recordings
The Licensor grants Users rights only to the extent that the Licensor is legally entitled to grant such rights.
By making an audio recording available in the catalog, the Licensor confirms that the Licensor possesses the necessary rights or other lawful grounds to grant the permissions provided for under this License.
This License does not govern the User’s use of any other musical works, phonograms, or recordings that are not included in the Website’s catalog.
8. Fees
This License is royalty-free and provided at no charge.
The Website may generate revenue from advertising, affiliate or sponsored materials, voluntary donations, and other forms of monetization of the Website itself. Such monetization does not affect the royalty-free nature of the license granted to the User for the audio recordings.
9. Amendments
The Licensor may publish revised versions of this License.
A new version applies to audio recordings obtained after the date on which that version takes effect.
Rights to audio recordings previously obtained by a User under the version of the License then in effect shall remain valid to the extent originally granted.
